These Terms and Conditions govern your use of Pulse of Time (“the App”, “we”, “us”, or “our”).

By downloading, accessing, purchasing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App

The App is designed for use on Apple Vision Pro and provides immersive spatial experiences, including 3D recreated scenes, visual content, audio, narration, and related interactive or cinematic features.

You agree to use the App only for lawful, personal, and non-commercial purposes, unless we give you written permission otherwise.

You must not misuse the App, attempt to interfere with its operation, reverse engineer it, copy its content, or use it in a way that could damage the App, our services, Apple services, or other users’ devices.

2. Apple Vision Pro Safety

The App may include immersive visual and audio experiences. Before using the App, make sure you are in a safe, clear, and controlled environment.

Do not use the App near stairs, balconies, roads, moving vehicles, sharp objects, glass, mirrors, windows, heat sources, or any other hazards. Do not use the App while walking in unsafe areas, operating a vehicle, riding a bicycle, using machinery, or doing anything that requires your full attention.

You are responsible for your own safety and surroundings while using the App.

Stop using the App immediately if you feel discomfort, dizziness, nausea, eye strain, motion sickness, disorientation, or any other physical discomfort.

3. Immersive and Historical Content

The App may include immersive recreations of real events, historical periods, natural events, extinct animals, environments, or other documentary-style scenes.

Some scenes may be artistic, cinematic, or interpretive recreations. While we aim to create a respectful and high-quality experience, the App should not be treated as a complete, exact, or authoritative historical record.

The App is intended for entertainment, educational, and documentary-style purposes only.

4. In-App Purchases

The App may offer a non-consumable in-app purchase to unlock content, experiences, or features.

All purchases are processed by Apple through the App Store. We do not process payments directly and we do not receive or store your payment card details.

Once purchased, non-consumable content is intended to remain available to you according to Apple’s App Store rules and your Apple ID entitlements.

5. Restoring Purchases

If you reinstall the App or use it on another compatible Apple device with the same Apple ID, you may be able to restore your previous non-consumable purchase using the App’s restore purchase feature.

Access to purchased content may depend on Apple’s systems, your Apple ID, device compatibility, App Store availability, and the current version of the App.

6. Refunds

Refunds for App Store purchases are handled by Apple according to Apple’s own terms and refund policies.

We cannot directly issue App Store refunds. If you want to request a refund, you must do so through Apple.

7. Push Notifications

The App may ask for your permission to send push notifications.

Notifications are optional. You can allow, disable, or manage notifications at any time in your Apple Vision Pro settings and in the app settings.

We may use notifications to inform you about app updates, new content, new experiences, important app-related information, or similar messages related to the App.

8. Intellectual Property

The App, including its visuals, 3D content, designs, animations, audio, narration, text, interface, logos, names, and other materials, is owned by us or licensed to us.

You are granted a limited, personal, non-transferable, non-exclusive license to use the App on compatible Apple devices according to these Terms and Apple’s applicable terms.

You may not copy, reproduce, modify, distribute, sell, rent, sublicense, extract, or reuse any part of the App or its content without our prior written permission.

9. App Availability and Updates

We may update, improve, modify, suspend, or discontinue parts of the App at any time.

Some features or content may require a compatible device, a specific visionOS version, an internet connection, App Store availability, or an updated version of the App.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system version.

10. No Warranty

The App is provided “as is” and “as available.”

To the maximum extent permitted by law, we make no warranties, express or implied, regarding the App, including warranties of performance, availability, accuracy, reliability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, we are not responsible for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

This includes, but is not limited to, loss of data, loss of profits, device issues, discomfort, injury caused by unsafe use, or problems caused by failure to follow safety instructions.

Nothing in these Terms limits liability where such limitation is not allowed by law.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how the App handles data.

13. Apple Terms

Because the App is distributed through the App Store, your use of the App is also subject to Apple’s applicable App Store terms, Apple Media Services terms, and Apple’s Licensed Application End User License Agreement unless a custom license agreement applies.

If there is a conflict between these Terms and Apple’s applicable terms, Apple’s terms may apply where required.

14. Changes to These Terms

We may update these Terms from time to time.

If we make changes, we will update the “Last updated” date above. Your continued use of the App after changes are posted means you accept the updated Terms.
